To exercise the rights granted by the data protection regulations, please send an e-mail to the following address lopd@servycat.com including the right you want to exercise in the title of the message and attaching a copy of your National Identity Document or Passport.

You are entitled to the following rights:

  • Right to have your data amended
  • Right to have your data deleted
  • Right to data portability
  • Right to restrict the processing of your data
  • Right to oppose to the processing of your data
  • Right to refuse to be the subject of profiling

Right to access your data:

You have the right to be informed by the Responsible, whether or not your personal data are being processed and, in case they are, to be allowed to access them and be provided with the following information:

  • Purposes of data processing
  • Categories of data being processed
  • Retention period or retention criteria for your data

Right to have your data amended:

You have the right to have your data amended by the Responsible, when they are inaccurate or incomplete, through an additional amendment.


Right to have your data deleted:

The interested party has the right to have their data deleted by the Responsible in case:

  • data are being unlawfully processed
  • the interested party has withdrawn consent
  • data are no longer necessary for the purposes they were collected or processed for
  • the interested party has exercised their right of opposition and there are no other lawful reasons for data processing
  • The data should be deleted in compliance with a legal obligation of the Responsible

The interested party shall not have the right to have their data deleted by the Responsible when data processing is necessary:

  • to exercise the right to freedom of expression and information
  • to comply with a legal obligation of the Responsible
  • to formulate, exercise or defend a claim
  • for reasons of public interest, in accordance with the regulations in force, due to public health reasons or historical, statistical or scientific research

Right to data portability:

You have the right to have your data transferred by the Responsible to another data processing Responsible or to the interested party, in a structured, commonly used and machine-readable format, when data are processed through automated means, based on:

  • consent by the interested party for specific purposes
  • exercise of a contract or pre-contract with the interested party

The right to data portability shall not be applied in case:

  • portability is technically impossible
  • portability may hinder the rights and freedoms of third parties
  • data are being processed within a public interest mission based on the regulations in force

Right to restrict the processing of your data:

The interested party has the right to oppose to the processing of their data by the Responsible for reasons related to their particular situation, when data processing is based on:

  • direct marketing
  • profiling
  • lawful interest of the Responsible or third parties, provided that the interests or the rights and freedoms of the interested party – in particular if he or she is a child – do not prevail
  • Historical, statistical or scientific research; provided that data processing is not necessary for public interest reasons

Even if the interested party opposes to the processing of their data, the Responsible may continue to process them provided that the lawful interest of the Responsible outweighs the interests, rights and freedoms of the interested party, in a legal procedure.

The Responsible shall explicitly and clearly inform the interested party of their right to oppose to the processing of their data, and present this information separated from any other information, at the time of the first communication.


Right to refuse to be the subject of profiling:

The interested party has the right to refuse to be the subject of profiling for purposes of making individual decisions based on automated data processing, aimed at evaluating, analyzing or predicting the following personal aspects:

  • performance at work
  • economic situation
  • health
  • personal preferences or interests
  • reliability
  • behavior
  • location or movements

When profiling is based only on automatic processing:

  • the interested party shall have the right to be informed in case the decision that might be made could have legal effects that significantly affect them.
  • the interested party shall have the right to human intervention by the Responsible, to express their point of view and to impugn the decision, if data processing has been authorized through:
  • explicit consent by the interested party
  • a contract between the Responsible and the interested party

This shall not apply to the right to refuse to be the subject of profiling when a possible decision based on it, has been authorized through:

  • explicit consent by the interested party
  • a contract between the Responsible and interested party
  • data processing enforced by the regulations in force
